Cheque Bounce Rules 2025: Know Your Rights, Penalties & Filing Deadlines

In March 2023, Negotiable Instruments Act, 1881 will carry with it more severe punishment to those who bounced cheques, starting April 1, 2025. Legal notices may now be transmitted via email or SMS and claim confirmation, received within 30 days after a bounce. Drawers are allowed 15 days to make payment or payees can approach a case under d.138 within 30 days of having issued a notice.

Interim Compensation

Under the 2018 amendment which will be strengthened in 2025, courts will have the discretion to award up to 20 percent interim compensation to the payees as the trials run. This provides relief in terms of finance as the cases are settled and promotes trust in the use of checks.
