The Negotiable Instruments Act, 1881, which comes into effect on April 1, 2025, raises fines in case of cheque bouncing. Deliberate bounces are now subject to a maximum regime of two years in jail, as opposed to one year, and fines of up to two times the amount of the cheque to discourage wilful financial fraud.
Faster Complaint Process
The 2025 regulations will increase the days in which a complaint can be filed to 90 days compared to 30 days to give the payees more time. E-filing via digital portals accelerates it and courts aim at six-month resolution in order to achieve faster justice.
Mandatory Bank Notifications
Bank is currently required to issue SMS and email notifications on cheque bounce within 24 hours to both drawer and payee. An explanation of why the honour should not be given such as lack of money should be detailed, as this will decrease confusion and will help in solution.
Account Freeze for Repeat Offenders
Banks can also freeze accounts that have three consecutive cheques that have bounced in order to deter habitual defaulters. This enhances financial discipline and safeguard payees against recurring non-payments, enhancing trust in cheque transactions.
Digital Legal Notices
Legal notices may be delivered by mail through email or SMS and confirm the delivery within 30 days of bounce. Drawers must pay within 15 days or those to whom they are in arrears can make a filing under Section 138 within 30 days of the notice.
Interim Compensation Enhanced
In 2018, amended in 2025, courts are allowed to pay up to 20 per cent interim compensation to payees in trials. This guarantees the financial relief as cases are adjudicated leading to increased trust in the system.
